
A Federal High Court in Lagos will on May 8, 2026 rule on a request by former Niger State Governor Muazu Babangida Aliyu and his co-accused, Umar Muhammed Nasko, asking the court to dismiss the N1.5 billion fraud case against them.
Justice Yelim Bogoro fixed the date after lawyers for both sides presented and adopted their final written arguments on Thursday.
The case follows a complaint filed by the Economic and Financial Crimes Commission (EFCC). Faruk Abdallah represented the anti-corruption agency, while Y. Kalamu appeared for Aliyu. Mamman Mike Ousman, SAN, represented Nasko.
Both men are facing eight charges, including conspiracy and money laundering totalling N1,509,791,200.
While opposing the request to dismiss the case, EFCC counsel Abdallah reminded the court that the defendants were first arraigned on April 28, 2017.
He said the prosecution presented 11 witnesses and tendered several documents before closing its case.
He explained that Aliyu filed his written application on December 18, 2025, and that the EFCC had submitted its response.
On Nasko’s application, Abdallah told the court: “At the close of the prosecution’s case, the second defendant also opted to make a no-case submission.”
He added that Nasko filed his written request on November 23, 2025.
After hearing arguments from both the prosecution and defence teams, Justice Bogoro adjourned the matter and announced that the court would deliver its decision on May 8, 2026.
