Justice Joyce Abdulmalik of the Federal High Court, Abuja, has dismissed the suit seeking to restrain the Economic and Financial Crimes Commission (EFCC) from arresting the Lagos State Governor, Babajide Sanwo-Olu, at the end of his tenure in 2027.
The judge dismissed the suit on October 31 after the governor’s counsel, Gbenga Femi Akande, moved the motion for its withdrawal.
Sanwo-Olu had in a suit purportedly filed on his behalf by one Darlington Ozurumba in October alleged that the commission had concluded plans to arrest and prosecute him for alleged corruption at the end of his tenure.
In the suit, he sought an order restraining the EFCC from arresting or prosecuting him in connection with his tenure when he left office on May 29, 2027.

But in a statement issued a few days later, the state’s Attorney-General and Commissioner for Justice, Lawal Pedro (SAN) said the governor did not instruct anyone to file a case against the EFCC.
He said the state government would investigate how the case was filed without the governor’s knowledge.
On Tuesday, the EFCC counsel, Hadiza Afegbua, appeared in court only to discover that the suit had been dismissed since October 31.
After she noticed that the case was not among the 10 listed for the day’s business, she made an inquiry and was told that the suit had been struck out.
